Zoning Commission minutes 2/25/09

On February 25, 2009 the Newbury Township Zoning Commission (ZC) held their regular monthly meeting in the upstairs meeting room of Newbury Twon Hall at 7:25 p.m. Alice Munn called the meeting to order with Bill Skomrock Sr., Judd Douglas, Jerry Hudak, Lou Tomsic, Carolyn Paschke and Robert Ruckstuhl present.  The minutes of the Feb. 7, 2009 were approved and signed.

 

Lou Tomsic reported on the BZA meeting of Feb. 17, 2009 for a variance to expand a commercial building on Cross Creek Pkwy owned by The Mullett Co.  The addition did not infringe beyond the present non-conforming building status and was easily approved.  Judd Douglas reported on the BZA meeting of Feb. 24, 2009 for 2 variances for Camp HoMitaKoda.  Variance #1 to reuse existing tennis courts was approved with 3 conditions:  1) maintain the natural woodland setting/screening between the courts and the road and 2) erect new 13 high wire fence on east side to enclose/maintain north & south fences, 3) agree that new lighting or any major changes would require a new variance hearing.  Variance #2 for additional parking was continued to March 31, 2009 to allow the camp to present alternate parking lot layouts that could comply with the front setback.  The safety of an alternate south driveway was discouraged due to limited sight distances and the 55mph speeds on Auburn Rd.

 

Jerry Hudak expressed concern regarding HB148 as there is no definition of “general welfare”. He suggested clarification from the Planning Commission and Prosecutor’s Office.  Discussion continued about strengthening our resolution in case it should be needed and specific wording for adding “general welfare” to this amendment.

 

Karen Endres reported that the amendment 2008-1 and map changes to add Oberland Park to the Active Park District was completed and effective 2/20/09.

 

The ZC then reviewed and made final changes recommended for the next amendment 2009-1.  Jerry Hudak moved to Initiate Amendment 2009-1, Carolyn Paschke seconded the motion that passed by unanimous vote.  The final amendment must be presented to the Planning Commission in the next 5 days to meet their 3/10/09 meeting date.

 

The next regular Zoning Commission meeting will meet on Mar. 25. 2009 at 7:15 p.m.
