ZC September 28, 2011

On September 28, 2011 the Newbury Township Zoning Commission (ZC) held their regular monthly meeting in the upstairs meeting room of Newbury Town Hall. Carolyn Paschke called the meeting to order at 7:05 p.m. with Judd Douglas, Jerry Hudak, Alice Munn and alternates Sue Wagner & Steve Kitco present. The minutes of the 8-24-11 meeting were approved and duly signed.

Carolyn Paschke said there were no other items to consider and asked the board to continue to review/revise the new alternate energy wind turbines (WT) topic – Art. XXIV, Sec 24.05E stating that prime use is conditional, considering PC comments. Sec. 24.06 is out as it duplicates Sec.18.00.

Trustees should adopt new fee schedules for wind turbine application and decommissioning. The cost is not a zoning enforceable item. Supplemental documentation already exists in the zoning application form. The question was raised: do wind turbines need building dept. applications? Warning signs should be 2 x 3 ft, same as temporary signs with 2” high letters. Remove “flags” and add knox box.

Change the maximum height to the turbine plus blades, not just the tower height, eliminate “noise” as unenforceable, add keys for the electrical connection box - should be available for safety.

The ZC board considered the Planning Commission comments on merits, rejected some but kept others for safety reasons. Multiple towers would be the same as 24.05(2). The question of bonding and insurance (to protect the twp.) requires input from the prosecutor’s office and our trustees. Road use/damage must also be addressed by township, county and state. The zoning inspector should provide a WT summary for review by the sheriff’s office. Inquiries and complaints should go to the responsible party: owner, operator and/or business entity. What is the distinction between stop producing electricity vs. abandoning the WT?

Carolyn agreed to type up these changes for discussion with Susan Weiland prior to our next meeting. The next topic to be considered under alternate energy will be solar and woodburners.
