ZC September 26, 2012

On September 26, 2012 the Newbury Township Zoning Commission (ZC) held their regular scheduled monthly meeting in the upstairs meeting room of Newbury Town Hall.  Carolyn Paschke called the meeting to order at 7:10 p.m. with Judd Douglas, Sue Wagner, Margaret Avalon and new members Edward Delulius and Mike Nelson present.


Margaret Avalon moved and Sue Wagner seconded the approval of the August 22, 2012 minutes that passed by unanimous vote.

Carolyn Paschke welcomed the two new ZC members and asked them to introduce themselves.  Ed Delulius said he lived on Whitewood Rd. and was a retired firefighter from Highland Heights.  Mike Nelson lives on Bell Rd, and also is retired as a 24 year computer administrator.   Karen Endres described the history of our computer maintenance and problems thereof; she welcomed assistance from our new members who fill the terms of Alice Munn & Steve Kitko.

Ms. Paschke said she not received any feedback from the trustees on the amendment changes for the ZC previously approved code for wind turbines (WT), solar panels (SP), land-banking (LB) and conditional use (CU)  delivered for the trustees’ 9/5/12  meeting.

Margaret Avalon reiterated the definitions for 3 types of mulch: inorganic, passive organic and active organic that the board had previously accepted for the next set of code changes.  The board agreed to retain the current restrictions prohibiting composting along the 87 (B-1 zoned) corridor citing the pile-turning-odors as detrimental to the current and future business and commercial developments with the new Sharen & James Winery and plans for a future hotel.  Landscapers should remain as a Conditional Use in the M-1 (Ind’l zone) although many are presently located in the B-1 zone.

Judd Douglas said the board should – at the request of the trustees - define “composting” as the EPA Class IV definition: creation of controlled biological decomposition of organic solid waste.  Discussion continued regarding the previously submitted ZC code for “landbanking” that was not understood by the trustees and therefore not approved in the last amendment. The board agreed it was time to send these code changes to the Planning Commission. 

Carolyn Paschke called for a motion to send ZC Amendment 2012-1 (for WT, SP, LB, CU) to the Planning Commission for review:  Judd Douglas moved with Sue Wagner seconding the motion to also include the definitions for mulch and composting, permitted chimneys and outdoor boilers, that passed by unanimous vote:

The board voted to set October 24, 2012 at 7:30 p.m. as the date for the Zoning Amendment #2012-1 Public Hearing as part of the ZC regular scheduled meeting.

Ongoing Work: Size Limitations for accessory Buildings – now 1280 sq.ft. per lot or 500 sq.ft. per acre whichever is larger – with floor area clarification for single vs. two story square footage, attached vs. detached garages & accessory buildings and maximum overall size.  Parking chart/size review, especially for multiple tenant usage, permitted sidewalks within front setbacks and more user-friendly swimming pool setbacks were also postponed as topics for the next meeting.  Lot coverage, pervious pavers, for better storm water management as used at the Chester Town Hall, are also considerations for future board review.

NZC compliance with Model Zoning code is an ongoing review basis.  Political signs are being posted sooner than the 45 days allowed due to permitted absentee and early voting. Corrections need to be made to the NZC outlines to match previous revisions.

The next ZC meeting is scheduled for October 24, 2012 at 7:00 p.m.
