ZC October 24, 2012

On October 24, 2012 the Newbury Township Zoning Commission (ZC) held their regular scheduled monthly meeting in the upstairs meeting room of Newbury Town Hall.  Carolyn Paschke called the meeting to order at 7:15 p.m. with Jerry Hudak, Judd Douglas, Sue Wagner, Margaret Avalon and new members Edward Delulius and Mike Nelson present.

 

Judd Douglas moved and Sue Wagner seconded the approval of the September 26, 2012 minutes that passed by unanimous vote.

Carolyn Paschke presented a brief summary of the amendment changes (2012-1) for the ZC previously approved code for wind turbines (WT), solar panels (SP), land-banking (LB) and conditional use (CU)  that she had delivered for the trustees’ 9/5/12  meeting.  

The board reviewed the Planning Commission’s comments on the proposed 2012-1 amendment and agreed to postpone any public hearing till the PC’s concerns had been resolved.

Ms. Paschke said she felt that Glen Quigley’s email comments regarding “wind farms in residential areas” were blown out of proportion and that he did not fully understand the code as presented. 

Sue Wagner and Lou Tomsic had used Auburn’s code as a model for EPA permitted small (<5 mw) WT that the Planning Commission subsequently questioned whether townships had the authority to require fees and bonds for reclaiming roads and decommissioning WT – answers should come from prosecutor’s office.  It was also noted that state grant assistance for WT is no longer available reducing new WT applications.

Mike Nelson didn’t understand Glen Quigley’s comments that zoning codes for WT were not needed.  Sue Wagner said if WT were permitted they needed some regulations.  More discussion on WT should be scheduled for the January Tri-Board meeting where trustees, ZC and BZA members share their concerns and offer suggestions to revise regulations for commonly approved  area variance requests and address conditional use violations/corrections in the business district.

The board recommended using the ORC definition for composting and adding “mulch sales” to prohibited uses in the B-1 district.  The board concluded that the definitions for Conditional Use and Land Banking should be re-submitted to the Planning Commission.

New items for review should include streamlined parking spaces in NZR 11.06C.

The next ZC meeting is scheduled for November 28, 2012 at 7:00 p.m.

Ms. Paschke adjourned the meeting at 9:15 p.m.
