Township Meeting - 8/4/2004

The regularly scheduled meeting of the Board of Township Trustees, Newbury Township was called to order at 7:33 p.m., August 4, 2004, with all members present.  Minutes of previous meetings were approved upon a motion by Mr. Quigley, a second by Mr. Majeski, and a unanimous affirmative vote.  

Fire activity reported by Mr. Fagan included 35 calls for the month of July, with 284 calls year-to-date.  Mr. Fagan requested that the trustees ask the Police Department for their assistance in traffic control during the August 21st 50 year celebration.  

Mr. Quigley reported that most of the repaving project was completed, with some berm work and striping yet to be completed.  Karen Endres suggested that the trustees consider sending some people to a Zoning Seminar to be held in Cleveland in the near future, at a cost of $85 per person.  The trustees agreed with this idea.

Mr. Majeski asked some questions of Mr. Fagan regarding the possibility of the Fire Department doing a controlled burn of condemned structures as a means of helping owners who cannot afford to remove these buildings by themselves; Mr. Fagan said that the Fire Chief would have to review this idea, and that there are some restrictions and internal policies that might make such a plan unworkable at this point.   

Mr. Majeski discussed the current budgetary restrictions in the General Fund, and stated that he thought that the Board should consider after the end of this year if it would be able to continue the position of Assistant Zoning Inspector.  

Mr. Fioritto reported that he had followed up on a letter from the Ohio Department of Liquor Control, saying that neither the Newbury Police Department or the Geauga Sheriff’s Department had any objection to renewals of liquor permits within the township.

The trustees discussed final revisions to the Newbury Township Cemetery Regulations.  Labor Day was included on the list of holidays on which burials are not conducted.  The trustees established new fees for openings and closings, with differential rates on weekends and holidays, and disinterment fees to be established with the same rates.

Mr. Quigley brought up the issue of naming a second alternate for the Zoning Board of Appeals.  The other trustees agreed with this idea, deciding to place an ad in the newspaper and make a selection at the first meeting in October.  The trustees also agreed that a stenographer for specific ZBA hearings be selected, starting the process by placing an ad for this position also.

Mr. Fioritto provided an update on Newbury’s appeal on their standing in the Haueter Asphalt case.  Mr. Fioritto reported that the court would probably take two to four weeks to come to a final decision after hearing from attorneys on both sides of this issue.

Mr. Fioritto said that he had heard from Mr. Skowronski of the Ohio EPA, who reported that it appears that two buried tankers have been discovered on the Manfredi Motor Transit property, directly south of the original excavation site where a series of buried concrete pipes were discovered last year.  Mr. Quigley delivered an All Erection Crane Rental update, stating that additional information was being requested by the plaintiff.  Mr. Fioritto reported on progress toward picking a new health insurance carrier, and also reported that the Warranty Deed for the new property at the corner of Rt. 87 and Auburn Road.

Mr. Majeski presented a report on the Rabid Raccoon Pellet Drop, to be conducted on August 5th.   
Mr. Quigley presented a draft Weapons Policy, based on Geauga County Policy.  After some discussion, it was decided to table action on this policy pending further review of this subject.  Mr. Quigley also provided a legal opinion from Stacey Reid on the issue of speed bumps; while it appeared that installing speed bumps would be a legal action for the township to take, the problems which speed bumps might cause made them not recommended, in her opinion.
