Township Meeting - 12/15/2004

The regularly scheduled meeting of the Board of Township Trustees, Newbury Township was called to order on December 15, 2004 at 7:30 p.m., with Mr. Quigley and Mr. Fioritto present.   Mr. Fioritto reported that Mr. Majeski could not be present at tonight’s meeting due to illness.   Mr. Quigley moved to accept the minutes of the previous meeting; Mr. Fioritto seconded this motion, which passed by unanimous vote.   
Mr. Fagan reported 490 fire department calls year-to-date, and 21 calls month-to-date.  He noted that the Fire Department Trustees were present and wanted to present a proposed 2005 contract, which is identical in wording and contract amount to the 2004 contract, despite increases in expenses experienced by the department for various items.  The trustees said that they would review the contract, and Mr. Lair said he would let the department know if there were any financial issues that would prevent the trustees from renewing the contract based on the same financial terms as the 2004 contract.    
Road activity reported by Mr. Hollis in addition to recent snow removal activity included installation of plow markers and street signs, as well as departmental assistance in the Christmas tree setup.  It was noted that the County Engineer’s office said that they recommended that the township not spend additional monies next year on Lucky Bell Lane, as the repairs that the township had recently performed on that road would keep it in good shape for a number of years more.
It was noted that Police Chief Battaglia could not be present due to illness, and that the trustees were in receipt of a police activity report covering the period through November.  It was reported that Karen Endres has submitted a Zoning Report covering the period through November.  It was also reported that in reviewing the notification procedures used by the Burton Township Zoning Board of Appeals on a recent case involving property adjacent to Newbury Township, they did not notify adjoining property owners located in Newbury Township of this hearing.   
Mr. Fioritto reported that the trustees were still waiting for action from Cebridge on renewal of their cable television Franchise Agreement.  Mr. Fioritto noted that the recently executed franchise agreement with Adelphia provides the township $15,000 for equipment, and a dedicated access channel.  Mr. Quigley and Mr. Lair both complimented Mr. Fioritto for his efforts in securing these resources from Adelphia as part of their franchise agreement renewal.
Mrs. Endres reported that she was working on resolution of a political sign that was in the road right of way and oversized.  She also addressed the issue of possible permit fees for co-location on a tower for a non-public utility enterprise.  Mr. Quigley moved that the trustees establish the zoning permit fee of $250 for a non-PUCO enterprise applying to co-locate on an existing tower, effective immediately.  Mr. Fioritto seconded this motion, which passed by unanimous vote.
Mr. Fioritto moved that the trustees pass Resolution 20041215001, Accepting the Amounts and Rates as Determined by the Budget Commission and Authorizing the Necessary Tax Levies and Certifying them to the County Auditor.  Mr. Quigley seconded this motion, which passed by unanimous vote.
Mr. Quigley moved that the trustees pass Resolution 20041215002, designating David Lair as the township’s authorized user for the National City Bank Online Banking system.  Mr. Fioritto seconded this motion, which passed by unanimous vote.
At the request of the clerk, Mr. Fioritto moved that $2500 be transferred from Road and Bridge – Repairs to Road and Bridge – Materials, and that $2500 be transferred from Road and Bridge – Insurance to Road and Bridge – Materials.  Mr. Quigley seconded this motion, which passed by unanimous vote.
The trustees set a meeting time and date of 7pm on December 29th for the year-end meeting.  The trustees agreed with a recommendation from Mr. Lair and Mrs. Nokes that the administrative office be closed during the last week of December and the first week of January, for year-end accounting activities.  It was noted that the township had received an update to the Manfredi Repository from the Twinsburg office of the Ohio EPA, reflecting activities at the Manfredi site through the end of November.  It was also reported that the company had officially changed their name from Manfredi Motor Transit to DistTech.  After the trustees passed along their Christmas greetings, this meeting was adjourned at 9:05 p.m., upon a motion by Mr. Quigley, a second by Mr. Fioritto, and a unanimous affirmative vote.

A special meeting of the Board of Township Trustees, Newbury Township was called to order at 7:04 p.m., December 29, 2004, with all members present.   Mr. Fioritto reported that notice of this meeting had been placed in accordance with Sunshine Law requirements.
At the request of the Clerk, Mr. Quigley moved that the trustees pass Resolution 20041229001 to transfer funds between accounts as follows:
$5,000 from Road District – Contracted Services to Road District – Employers’ Retirement Contribution, $500 from Police – Equipment to Police – Salaries, $2000 from General – Other to Salary – Administrator, and $1000 from General – Other to General – Lighting Contract.  Mr. Majeski seconded this motion, which passed by unanimous vote.
Mr. Majeski moved that the trustees pass Resolution 20041229002, to receive from the County Auditor an advance of all available taxes from all available funds on the first half property tax collection.  Mr. Quigley seconded this motion, which passed by unanimous vote.
The trustees and the Clerk discussed township finances and ideas for preserving balances in the General Fund.  The trustees signed the Annual Township Highway Mileage Report, as requested by the County Engineer.
Mr. Majeski read a letter addressed to Congressman Steven LaTourette from Keith Tompkins, President of Kinetico, requesting his support in developing funding for turning lanes at the intersection of Auburn Rd. and Rt. 87.   The trustees discussed this initiative and other issues involved in township infrastructure development.  It was noted that the township’s Motion to Intervene in the Haueter case was denied, in a split decision by the Eleventh District Appellate Court.  The trustees discussed the possibility of filing an appeal with the Ohio Supreme Court.   Mr. Quigley moved that the trustees file a request for appeal with the Ohio Supreme Court; Mr. Majeski seconded this motion, which passed by unanimous late.
The trustees discussed proposals for repair or replacement of a boiler at the Fire Department; Mr. Majeski moved that the fire department proceed with the appropriate repairs at their discretion.  Mr. Quigley seconded this motion, which passed by unanimous vote.  A general discussion period covered topics including possible sale of cemetery plots to non-residents.
