Township Meeting - 10/6/2004

The regularly scheduled meeting of the Board of Township Trustees, Newbury Township was called to order on October 6, 2004 at 7:30 p.m., with all members present.    Ms. Kate Ritchie with the Geauga County Department on Aging spoke to the trustees and audience to ask for help in covering a meal route to help senior residents in Newbury.  She also asked for assistance in finding help for the Senior Fix-up Program, starting on Saturday, October 9th and left information with the trustees regarding the services offered by the Department on Aging, and briefly discussed Issue 44, the upcoming Senior Services Levy to be voted on in November.  Mr. Dean Eppley addressed the trustees regarding an issue involving the handling of a zoning dispute with an individual attempting to operate an excavating company.    Mr. Fioritto moved to accept the minutes of previous meetings, with one correction; Mr. Majeski seconded this motion, which passed by unanimous vote.  

Mr. Les Ober presented a recap of activity to-date for the Newbury Park Board.  The Park Board is in the process of completing creation of the group’s by-laws.
Mr. Ober reported that repair work on the Grange Park Shelter roof would commence on the 14th of this month, to be completed shortly thereafter.  The group is also working on plans to preserve natural portions of Oberland Park, and will be meeting with the Chagrin River Land Conservancy in the near future to obtain their input.  One issue reported by Mr. Ober as having been discussed by the Park Board was the problem of ATV riders trespassing across the Oberland Park property.  Also discussed were ideas for planning landscaping and design for the newly acquired property on the southwest corner of Auburn and Rt. 87.  Mr. Majeski expressed hope that an area landscaper could be invited to develop plans for a basic design for the corner including a gazebo and water fountain, and that area businesses might have some interest in helping to finance a basic design of this sort.

Mr. Quigley commented on the passing of former Fire Chief Elmer Smith, citing his knowledge and dedication to Newbury Volunteer Fire Dept., and lamenting the passage of both Chief Smith and former Chief Donald Rauch, who passed away several weeks ago.   Mr. Quigley reported on the drainage ditch issue involving a private property located south of Hillview Rd.; the property owner has given the township authorization to enter onto the property and open up the ditch that drains toward Silver’s Lake, which will eliminate standing water that has been a problem in the new culvert installed under Hillview, just east of Stone Rd.  Mr. Quigley reported that the township’s legal representative had just filed for a summary judgment in the All-Erection Crane case, in an effort to bring final resolution to this issue.  Mr. Majeski reported that attorney Mike Lamanna had not gotten back any information on the township’s status in the Haueter case.

Mr. Majeski said that Assistant County Prosecutor Stacey Reid had provided the trustees with some guidance on ways under the ORC to deal with vehicles parked in roadways in Kiwanis Lake.  The trustees agreed that Chief Battaglia should be directed to enforce the applicable ORC section by issuing tickets to illegally parked vehicles.  Mr. Quigley reported that he had received information from the Chagrin River Watershed Partners regarding possible actions to preserve wetlands areas of the Oberland Park property, while reducing the possibility of flooding in the Kiwanis Lake area.  Mrs. Endres reported that she had spoken to Zoning Inspector Michael Joyce from Chester Township, where a procedure has been created to deal with blighted structures; Mrs. Endres provided each of the trustees with a copy of this procedure.  Mrs. Endres reported on the zoning seminar that she and Marge Hrabak had recently attended, saying it was very worthwhile.

A general discussion period included comments and ideas regarding the new auto attendant system, possible incorporation of riparian setback regulations in township zoning, and Phase II storm water runoff issues.  The trustees decided to table a decision on a ZBA alternate until applications received from previous advertisements were reviewed, along with current applications.  Correspondence received since the last meeting was reviewed by Mr. Fioritto.
