Nature Works Grant
*Upon completing requirements for the nature works grant final reimbursement is was discovered that Appendix “L” needed completed which required the county to file a dead restriction on the property so that any future development would need to be approved by ODNR. Concerned with the language in the document the trustees asked Susan Wieland, attorney for the county to look it over. Her recommendation is as follows:
1. It's possible we can negotiate a parcel size smaller than the entire 88 acres to be encumbered by ODNR's right of approval for any changes but it won't be limited to just the Nature Trail and a buffer around it which we estimated at 15 acres. It appears the minimum ODNR will accept is more likely 25 to 30 acres and must include the driveway access from Auburn Road. Any cost involved in surveying, describing and recording this parcel would be entirely for our account and cannot be reimbursed by the grant.
2. If any revisions of the original grant are negotiated, these changes cannot include any change in the term. Whatever is agreed upon will bind the township forever. This is part of the enabling legislation and there can be no exception.
3. The township is not at this point bound by any terms of the grant and can withdraw without penalty.
* David Snively requested the board make a recommendation to the Newbury Township Trustees regarding how to proceed with the grant.
*After discussing all options it was decided that the Park Board did not want the entire property under ODNR control for a small grant of about $17,000 when we had a larger grant in jeopardy and future plans for the property needing 3rd party approval. Therefore, the Park Board recommended the trustees turn down the grant with the stipulation that the Board proceed with getting the property protected as it would no longer be under ODNR restrictions. Trustees assured Park Board there were enough fund in trustee budget to cover the cost.
